General rules for accessing and using the RomDoc platform.

Introduction
# ROMDOC TERMS AND CONDITIONS OF USE
1. Operator information

2. Acceptance of Terms and Conditions
By accessing, using or creating an account on the Platform, you confirm that you have read, understood and accepted these Terms and Conditions. If you do not agree to these Terms and Conditions, you must not use the Platform. Certain features may be subject to additional terms and conditions, which are displayed prior to their use. In the event of a conflict, the special terms will prevail only for the feature to which they refer.
3. Definitions
Within these Terms and Conditions: * **Platform** means the RomDoc website, applications, functionalities and associated digital services; * **Operator** means the legal entity that administers RomDoc; * **User** means any person who accesses or uses the Platform; * **Patient** means the user who searches for a doctor, creates a patient account, or requests an appointment; * **Doctor** means the medical professional who creates and manages a professional profile on RomDoc; * **Clinic** means the provider or location where medical services are provided; * **Medical or administrative personnel** means persons authorized by a doctor to administer certain functionalities, within the limits of the granted permissions; * **Medical provider** means the physician, clinic or other professional who actually provides the medical service; * **Appointment** means requesting or booking a consultation or other service offered by a medical provider; * **Content** means the texts, images, documents, reviews, professional information and any other materials available on the Platform.
4. The role of RomDoc
RomDoc is a digital platform that facilitates: * search for doctors, clinics, specialties and medical services; * consulting professional profiles; * sending and managing scheduling requests; * communication of notifications regarding appointments; * management of patient, doctor and authorized personnel accounts; * publishing reviews, under the conditions established by the Platform; * administrative verification of certain professional information declared by doctors. RomDoc is not a hospital, clinic, medical office, medical service provider, or emergency service. The operator does not perform consultations, establish diagnoses, prescribe treatments, or make medical decisions on behalf of doctors or patients. The contract for the actual provision of the medical service is concluded between the patient and the chosen doctor, clinic or medical provider. RomDoc does not become part of the medical relationship between the patient and the provider.
5. Emergency situations
The platform should not be used for medical emergencies. In the event of an emergency or a situation that may endanger a person's life or health, immediately call **112** or go to the nearest emergency medical facility. Messages, forms and requests sent through RomDoc are not permanently monitored and do not guarantee an immediate response.
6. Eligibility and account creation
To create an account you must be at least 18 years old and have the legal capacity to accept these Terms and Conditions. In the case of services intended for a minor, the request must be made by the parent, guardian or legal representative, to the extent that the functionality is available and the medical provider accepts the appointment. When creating and using your account, you agree to: * provide real, accurate, complete and up-to-date information; * update information when it changes; * maintain the confidentiality of your login details; * do not allow other people to use your account; * inform us without delay if you suspect unauthorized access to your account; * do not create fake accounts or accounts in the names of other people without authorization. You are responsible for the activities carried out through your account, to the extent that they are attributable to you. RomDoc may request email address verification, additional authentication, or other reasonable security measures.
7. Searching and selecting medical providers
Information displayed on doctor and clinic profiles may include specialty, experience, services, approximate rates, locations, availability, languages spoken, and other professional information. Some of this information is provided and administered directly by physicians or their authorized representatives. RomDoc makes reasonable efforts to maintain the accuracy of the information, but does not guarantee that all data is permanently complete, up-to-date or error-free. The patient is responsible for checking, before the consultation: * the identity and specialty of the doctor; * location of the consultation; * final price; * services included; * the necessary documents; * the conditions of the clinic or office; * acceptance of insurance, a shipping ticket or a payment method. The display of a doctor in the search results does not constitute a personalized medical recommendation and does not guarantee that that doctor is suitable for the patient's particular situation.
8. Requesting and confirming appointments
Submitting a request through RomDoc does not automatically mean that the appointment has been confirmed. A request may have, as the case may be, one of the following statuses: * in waiting ; * confirmed ; * rescheduled ; * completed ; * cancelled ; * absent patient ; * another status displayed in the user's account. The appointment becomes confirmed only after confirmation sent via the Platform, email or by other means indicated by the doctor or clinic. The doctor, clinic or authorized personnel can confirm, refuse, cancel or propose rescheduling a request, depending on actual availability and their own rules. The patient must check the appointment status and ensure that the contact details provided are correct.
9. Rescheduling, cancellations and no-shows
The patient can cancel an appointment through the functionality available in the account, if the status and time of the appointment allow this action. In the current version of the Platform, the patient can request a new appointment, but is not guaranteed the right to directly change the date or time of an existing appointment. Rescheduling can be done by the doctor or authorized personnel. The medical provider can set their own rules regarding: * minimum cancellation period; * patient delay; * failure to appear; * any associated fees; * reimbursement of amounts paid directly to the medical provider. These rules must be communicated to the patient by the medical provider and are not established by RomDoc, except in situations where the Platform expressly indicates otherwise. Canceling an appointment through the Platform does not automatically imply a refund of any payment made directly to the doctor or clinic. Repeated and abusive use of the scheduling system, including fictitious requests or repeated no-shows, may lead to account limitation or suspension.
10. Notifications and communications
RomDoc may transmit operational communications regarding: * account creation and security; * email address verification; * requesting an appointment; * confirmation, rescheduling or cancellation of the appointment; * reminder of an appointment; * changing the status of an appointment; * account activity; * doctor's subscription; * requests regarding data protection or account closure. These communications are necessary for the operation of the service and do not constitute marketing communications. RomDoc does not guarantee instant delivery of every message. Delivery may be affected by email providers, spam filters, device settings, technical outages, or incorrect contact details. The user remains responsible for checking the status of appointments in the account and for directly contacting the medical provider when the situation requires it. Marketing communications will only be sent under the conditions provided by law and can be deactivated separately.
11. Obligations of doctors and clinics
Doctors, clinics and their authorized representatives undertake to: * to provide real, complete and up-to-date professional information; * to hold all the authorizations, qualifications and rights necessary to practice the profession; * to comply with the legislation applicable to the medical profession and services; * not to publish titles, skills, specializations or certifications that they do not hold; * update availability and location information; * to communicate services and rates correctly; * manage appointments in good faith; * respect the confidentiality and rights of patients; * use patient data only for legitimate purposes; * not to discriminate against patients; * not to publish content that is misleading, illegal or contrary to professional rules; * to be responsible for medical documents and the activity of their own staff; * to comply with their tax, accounting and contractual obligations. The physician is responsible for the accuracy of the profile and for the activity carried out through the staff accounts associated with his practice, within the limits provided by law and the technical permissions granted. RomDoc may request supporting documents, correct obvious errors, suspend the display of a profile, or request that information be updated.
12. Professional verification
RomDoc can offer certain doctors the mark: **"Doctor verified by RomDoc"** This mark indicates that RomDoc has administratively verified certain information or professional documents available at the time of verification. The marking does not mean that: * RomDoc has issued a medical license or authorization; * RomDoc guarantees the quality of a medical document; * RomDoc recommends a doctor for a specific patient; * RomDoc permanently supervises the doctor's professional activity; * the doctor is the employee or representative of RomDoc. The right to practice is granted and regulated by competent authorities and professional bodies, not by RomDoc. RomDoc may suspend, withdraw or mark verification as expired when the documents expire, the information can no longer be confirmed or justified reasons arise regarding their accuracy. A doctor's membership and their professional verification are separate elements. Paying for a membership does not guarantee obtaining the verification mark.
13. Doctors' subscriptions
Certain functionalities intended for doctors are available on a paid subscription basis. The price, billing period, applicable taxes, and included features are displayed before payment is initiated. Subscriptions may be offered monthly, annually or for other periods indicated on the Platform. The payment is processed through an external payment service provider. RomDoc does not directly store the full card details. Unless otherwise indicated, the subscription: * starts after payment confirmation; * automatically renews at the end of the billing period; * can be canceled from the billing portal or by the method indicated on the Platform; * remains active until the end of the period already paid, unless the cancellation states otherwise. The physician must ensure that the payment method is valid and that the billing information is correct. In the event of a failed payment, RomDoc may apply a grace period, limit certain functionalities, or suspend access to paid features. Termination of the subscription does not automatically delete the account, previous appointments, or data that must be retained for legal, security, or user rights reasons. Subscriptions for doctors are intended for use in the context of a professional activity. The conditions regarding withdrawal, cancellation and reimbursement apply according to the nature of the contractual relationship and the applicable mandatory legislation. Except for situations provided for by law or expressly indicated by RomDoc, amounts related to a subscription period that has already begun are not reimbursed proportionally. RomDoc may change prices for future periods, with prior notice to the subscriber. The change does not retroactively affect the period already paid.
14. Payments for medical services
Unless the Platform expressly indicates otherwise, payment for consultations or other medical services is made directly between the patient and the medical provider. RomDoc does not set the final consultation fee and is not responsible for: * issuing fiscal documents for the medical act; * the differences between an indicative tariff and the final tariff; * reimbursements due by the doctor or clinic; * insurance settlement; * additional services recommended during the consultation; * disputes regarding the payment of a medical service. The medical provider is responsible for informing the patient and fulfilling the fiscal and legal obligations related to the service provided.
15. Reviews
RomDoc may allow patients to publish reviews about their experience with a doctor or clinic. Reviews must be: * based on real experience; * formulated in good faith; * relevant to the service received; * free from offensive, threatening or discriminatory language; * free from false accusations or deliberately misleading statements; * free of excessive medical or personal data; * devoid of personal data belonging to other persons; * compliant with the law and the rights of third parties. Reviews are not allowed: * published in exchange for an undisclosed advantage; * written by the doctor about his own profile; * written by competitors with the aim of causing harm; * copied or published automatically; * containing advertising, spam or dangerous links; * that reveals confidential information about other people. RomDoc may use technical mechanisms to associate a review with a scheduling made through the Platform. RomDoc may refuse to publish, hide, limit or remove a review that violates these Terms, the law or the rights of a person. When appropriate, the author may be asked to clarify or modify the content. Moderating a review does not mean that RomDoc confirms or denies all the statements contained therein. Doctors and users can report content via the contact details displayed on the Platform. The report must indicate the content in question and the reasons why it is considered illegal or contrary to the rules.
16. User-provided content
The User retains the rights he holds over the content uploaded or transmitted through the Platform. By publishing content intended for public display, the user grants the Operator a non-exclusive, free license, valid for the duration of publication, to host, technically reproduce, adapt to the Platform format and display the content for the purpose of providing the service. The user guarantees that:
* has the right to transmit or publish that content; * the content does not violate the rights of other people; * the content is not illegal, false, fraudulent or dangerous; * the necessary approvals have been obtained for images or information about other people. This license does not transfer ownership of medical documents, professional notes, or private files to RomDoc.
17. Medical documents and sensitive information
If the Platform allows the uploading or management of medical documents, they will be accessible only to authorized persons, according to existing functionalities and permissions. Users should not upload more information than is necessary for the intended purpose. Physicians are responsible for the content, accuracy, and professional basis of the medical notes or documents they create. Patients should not alter, falsify, or present altered medical documents as authentic. Access to a medical document does not automatically grant the right to modify, publish, redistribute or use it for any other purpose. Detailed rules regarding data processing, retention, sharing and deletion are presented in the Privacy Policy and in the interface of the respective functionality.
18. Prohibited uses
It is prohibited to use the Platform for: * violation laws or rights OTHER people ; * unauthorized access to an account, system or document; * massive automatic data collection without the written approval of the Operator; * copying the database or profiles for competitive purposes; * transmitting malware or harmful code; * unauthorized vulnerability testing; * circumvention of authentication, authorization or payment mechanisms; * impersonating a doctor, patient, representative or staff member; * creating fictitious schedules; * harassment, discrimination, threats or fraud; * promoting illegal treatments or products; * uploading false documents; * interfering with the functioning of the Platform; * use of contact details for unsolicited commercial communications; * reselling access to the Platform without permission. RomDoc may investigate suspicious activities and take reasonable measures to protect users and the system.
19. Intellectual property
The platform, its structure, design, code, databases, graphic elements, the RomDoc brand and materials created by the Operator are protected by intellectual property legislation. Except for normal use of the Platform, copying, modification, distribution, publication, licensing or exploitation thereof is not permitted without the written consent of the Operator. rights on brands , images and mATERIALS belonging doctors , clinics or OTHER third parties remain with the owners respective .
20. Services provided by third parties
To provide the Platform, RomDoc may use technical services provided by third parties, including for: * hosting; * databases and authentication; * file storage; * payment processing; * sending emails; * maps and location; * security and performance monitoring. Use of certain features may involve interaction with the services of these providers and may be subject to their terms. RomDoc selects suppliers with reasonable care, but does not fully control the availability of external systems.
21. Platform Availability
RomDoc aims to maintain the Platform in a secure and functional state, but does not guarantee that it will be available without interruptions or errors. Access may be temporarily limited due to: * maintenance ; * updates ; * security incidents ; * malfunctions technical ; * unavailability of external suppliers; * events beyond the reasonable control of the Operator. RomDoc may modify, replace or withdraw certain functionalities. When a modification significantly affects a paid service, affected users will be reasonably informed.
22. Account suspension and closure
RomDoc may restrict, suspend or close an account when there are reasonable grounds, including: * violation of these Terms and Conditions; * providing false information; * fraudulent or abusive use; * risks to the security of the Platform; * violation of patients' rights; * lack of the right to practice declared by a doctor; * non-payment of a subscription; * the existence of a legal obligation or a request from a competent authority. When the situation allows, the user will be informed about the measure and the main reasons. The user can request account closure through the available functionality or by contacting RomDoc. Closing your account does not necessarily result in the immediate deletion of all data. Certain information may be retained when necessary to: * fulfillment of a legal obligation; * establishing, exercising or defending a right; * prevention of fraud and security incidents; * management of existing appointments and transactions; * compliance with legal archiving periods; * protecting the integrity of medical documents. Details are provided in the Privacy Policy.
23. Data protection
The processing of personal data is carried out in accordance with the RomDoc Privacy Policy and applicable legislation. The privacy policy describes, among other things: * the categories of data processed; * the purposes and grounds of the processing; * recipients of the data; * technical suppliers used; * retention periods; * the rights of data subjects; * how to submit a request.

24. RomDoc's liability
To the extent permitted by law, RomDoc is not responsible for: * diagnosis, treatment, recommendations or medical documents; * the professional conduct of a doctor or a clinic; * the result of a consultation or treatment; * cancellation or rescheduling decided by the medical provider; * incorrect information provided by a user; * differences between the indicative information and the final terms of the consultation; * patient's failure to appear; * failure to fulfill obligations by the doctor, clinic or patient; * interruptions caused by external suppliers or force majeure events; * losses resulting from improper use of the account; * content published by users, before the Operator effectively became aware of its illegal nature and had the reasonable opportunity to act. RomDoc does not exclude or limit liability in cases where such exclusion or limitation is prohibited by law. Nothing in these Terms limits the mandatory rights granted to consumers nor liability for fraud, intent, gross negligence or other situations that cannot be legally limited.
25. User liability
The User is liable for damages caused by violation of these Terms, the law or the rights of other persons, to the extent attributable to him. Doctors and clinics are directly responsible for the medical services provided, the professional information published, the activity of their own staff, and compliance with professional, fiscal, and legal obligations.
26. Reporting content and issues
To report illegal content, incorrect information, a security issue or abuse, you can contact us at: **[support@romdoc.fit](mailto:support@romdoc.fit)** The notification must include, as far as possible: * contact details of the reporting person; * page address or content identification; * explanation of the problem; * relevant supporting documents or information; * a statement that the information provided is accurate and submitted in good faith. RomDoc may request additional information and will analyze the complaint within a reasonable time, depending on its nature and complexity.
27. Modification of Terms and Conditions
RomDoc may update these Terms and Conditions to reflect: * legislative changes; * new functionalities; * changes in the business model; * security requirements; * clarifications regarding the use of the Platform. The updated version will be published on the Platform and will indicate the date of the last update. In the event of significant changes, RomDoc may inform users by email, in-account notification or other appropriate means. The changes will not retroactively affect rights already acquired, except as required by law.
28. Force majeure
Neither party is liable for failure to perform an obligation caused by a force majeure event or an unforeseeable event beyond its reasonable control, under the law. This provision does not affect obligations that must be performed according to mandatory legal norms.
29. Partial nullity
If any provision of these Terms is declared invalid, illegal or unenforceable, the other provisions shall remain valid. The affected provision will be interpreted or replaced, to the extent permitted by law, so as to reflect as closely as possible its original purpose.
30. Applicable law and dispute resolution
These Terms and Conditions are governed by Romanian law, without prejudice to mandatory rules applicable to users in other jurisdictions. Any disagreement will first be resolved amicably. If the user has the status of a consumer and the legal relationship falls under the scope of consumer protection legislation, he or she may also use the mechanisms or competent authorities provided for by law, including the National Authority for Consumer Protection, when applicable.
